Solium Individual Contributor License Agreement

Thank you for contributing to Solium. This agreement is between you and the Solium Maintainer (currently Illia Kotomin, together with any successor or assignee of the Maintainer’s rights in Solium). It sets out the terms under which you contribute. It is a license, not a transfer: you keep the copyright in your contribution and may use it however you like elsewhere.

You accept this agreement by opening a pull request that contains the following sentence, or by signing through the automated check on the pull request where one is enabled:

I have read the Solium CLA (CLA.md) and I agree to it for this and all my future contributions to Solium.

1. Definitions

  • “You” means the person who submits the Contribution. If you submit it on behalf of an employer or another organisation, “You” means that entity too, and you confirm that you are authorised to agree on its behalf.
  • “Contribution” means any original work of authorship, including changes to existing work, that You intentionally submit to the Maintainer for inclusion in Solium. That includes code, documentation, artwork, configuration and tests, submitted by any means, including a pull request, an issue, a patch, a comment or a message.
  • “Solium” means the software project published at https://github.com/Lilium-Linux/solium, together with any work the Maintainer derives from it.

You grant the Maintainer, and recipients of software distributed by the Maintainer, a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable license to reproduce, prepare derivative works of, publicly display, publicly perform, sublicense and distribute Your Contributions and such derivative works, under any license terms the Maintainer chooses, in addition to the license Solium is published under at the time.

The Maintainer may transfer or assign the rights granted in this agreement.

3. Patent license

You grant the Maintainer, and recipients of software distributed by the Maintainer, a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable (except as stated in this section) patent license to make, have made, use, offer to sell, sell, import and otherwise transfer Your Contributions. The license covers only those patent claims You can license that are necessarily infringed by Your Contribution alone, or by its combination with Solium as it stood when You submitted it.

If anyone starts patent litigation claiming that Your Contribution, or Solium, infringes a patent, the patent licenses that party received under this agreement end on the date that litigation is filed.

4. What you confirm

  • Each Contribution is Your original work, or You have the right to submit it under this agreement. Where a Contribution includes someone else’s work, You say so in the submission and name its source and license. Only work under a license compatible with this agreement’s terms may be included, such as MIT, BSD, Apache-2.0 or Zlib.
  • If an employer or anyone else has rights in what You create, You have their permission to make the Contribution under this agreement, or they have waived those rights.
  • You are not aware of any claim, license or other restriction that conflicts with the rights granted here.
  • You will tell the Maintainer if any of this stops being true.

5. Moral rights

To the extent the law allows, You waive, or agree not to assert, any moral rights in Your Contributions against the Maintainer or recipients, where those rights would prevent the uses permitted in section 2.

6. No obligation, no warranty

The Maintainer does not have to use Your Contribution. Unless required by law or agreed in writing, You provide Your Contributions “as is”, without warranties or conditions of any kind.

7. Everything else

This agreement covers every Contribution You make to Solium, now or in the future, until You tell the Maintainer in writing that it no longer covers future ones. That notice does not affect Contributions already made.

If any part of this agreement is held unenforceable, the rest remains in effect.
